1. Description of Services

AskingCanadians™ is the trademarked name for an online research panel operated by AskingCanadians Inc. ("AskingCanadians"). AskingCanadians conducts online surveys with members of the research panel to provide its clients with anonymous customer feedback in order to help its clients develop better products and services. Survey responses will also be used to populate AskingCanadians’ Insight Engine, a proprietary analytical database used by AskingCanadians for the purpose of analysing and understanding the digital behaviours and attitudes of Canadians. Information in the Insight Engine will be used in the aggregate for marketing initiatives such as enhancing digital marketing solutions, creating data marketing products, and/or publishing industry reports. As an incentive for providing customer feedback, AskingCanadians members can choose to earn either AskingCanadians points, Aeroplan® points, or 7Rewards™ points. Or they can choose to be rewarded in other ways, such as entries into contests and draws. Aeroplan and 7Rewards™ have no ownership or involvement in AskingCanadians and have no access to your personal information.

The program that AskingCanadians provides on this site ("Site") is subject to the following terms and conditions ("T&C"). AskingCanadians reserves the right to update, add, delete or change some or all of the T&C at any time without prior notice to you. When the T&C are changed, AskingCanadians will revise the "Last Updated" date at the top of the T&C. By joining AskingCanadians and using this Site you acknowledge that you have read, understood and agreed to be bound by the last updated version of the T&C and all documents incorporated by reference therein. If you do not agree with any provision of the T&C, you are not permitted to access or use the Site or join the AskingCanadians panel.

2. Eligibility for Participation

You must be the age of majority of the province in which you livein order to join AskingCanadians. If you do not qualify, please do not register for the AskingCanadians panel.

AskingCanadians may refuse its services to anyone at any time, at its sole discretion.

BY COMPLETING THE REGISTRATION PROCESS, YOU ARE STATING THAT YOU AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THIS AGREEMENT.

3. Program Terms

a. Contacting Members of the research panels: As a member of AskingCanadians, AskingCanadians will contact you to participate in our surveys using the e-mail address you provide upon registration.

b. Survey Participation: To participate in a survey, you must click onto the link that is provided in your e-mail invitation or cut and paste the link into your web browser. You will then be taken to the survey page where detailed survey instructions will appear.

c. Additional Surveys: You will be sent surveys by AskingCanadians and on behalf of clients of AskingCanadians based on the demographic information you provide when you sign-up for AskingCanadians. The number of surveys you will receive in a given month is directly related to the demographic profile required by AskingCanadians and AskingCanadians’ clients.

d. Reward Allocation: Depending on the reward choice you make upon registration, you will receive either AskingCanadians points, Aeroplan points, 7Rewards points or other incentives like entries into contests and draws each time you complete an AskingCanadians survey. The number of your chosen reward offered per survey and how you will receive that reward will be specific to each survey, and will be described in the e-mail invitation you receive, asking you to participate in a particular survey.

If you choose to receive Aeroplan points, your accurate Aeroplan account information is required in order to issue your points. If you choose to receive 7Rewards™ points, your 7Rewards™ account information is required in order to deposit your points.

To receive your chosen reward, you must complete a survey in its entirety. If you complete multiple copies of the same survey, only the first survey responses will be accepted.

e. Points Allocation into Accounts: For panelists earning AskingCanadians points, these will be allocated electronically to your AskingCanadians points account after you participate and complete a survey. For panelists earning Aeroplan points, points will be allocated electronically to your Aeroplan account after you participate and complete a survey. For panelists earning 7Rewards™ points, points will be deposited electronically into your 7Rewards™ account on a monthly basis following completion of a survey. The last page of each survey will indicate the timeframe in which you can expect to receive points in your account.

f. Points Expiration: Points collected by members in the AskingCanadians Points program (AskingCanadians points) expire after twelve (12) consecutive months of account inactivity. If the reward selection is changed (from AskingCanadians points), any unused AskingCanadians points will be removed from your account. Such points will be void, have no monetary value, and will not be eligible for recovery, transfer, or redemption.

4. Suspension and Forfeiture of Points

Without limiting other remedies, AskingCanadians may suspend or terminate your account and your access to the Site in its sole discretion for any reason, including but not limited to the following: (i) If it is apparent that you have not acted in good faith when participating in online surveys or online test markets. (ii) If it apparent that you have created additional accounts, exceeding the one account per member policy, with malicious intent. (iii) If you have engaged in dishonest, illegal or fraudulent activity. (iv) If your account remains inactive for twenty-four (24) consecutive months. In the event that an account is suspended, AskingCanadians reserves the right to remove and forfeit any unused AskingCanadians points remaining in the account. Such points will be void, have no monetary value, and will not be eligible for recovery, transfer, or redemption.

5. Breach

AskingCanadians may immediately issue a warning, temporarily suspend, indefinitely suspend or terminate your membership as a member of the research panel, if you breach any of the T&C or if AskingCanadians is unable to verify or authenticate any information you provide to AskingCanadians.

6. Privacy

Information collected from research panel members is subject to the terms of AskingCanadians’ AskingCanadians Privacy Policy. AskingCanadians’ Privacy Policy is incorporated herein by reference.

7. Respondent Confidentiality

By becoming a member of AskingCanadians , you agree that you will hold in strict confidence and not disclose to any other parties' information learned in connection with any survey, project, or questionnaire strictly for the purpose of providing market research activity related to AskingCanadians . You agree you will use the information contained in any survey, project or questionnaire strictly for the purpose of providing market research related data. You shall notify Customer Service should you discover any loss or unauthorized disclosure of the information. The kind of information you may learn in connection with a survey, project or questionnaire includes trade secrets, proprietary information, media content, unique techniques, sketches, drawings, works of authorship, models, inventions, know-how, research, experimental work, development, design details and specifications, sales and merchandising plans and other information provided relating to third parties.

8. Disclaimer, Limitation of Liability and Warranties

The performance of the Site and all content contained on, downloaded or accessed from the Site are provided to you on an "as is, where is, when available" basis. AskingCanadians disclaims all conditions, terms, representations and warranties, express or implied, statutory or otherwise, including but not limited to implied warranties of merchantability, merchantable quality, quality, fitness for a particular purpose, title and non-infringement, with respect to the Site or any of the content.

AskingCanadians reserves the right, at its sole discretion, to modify, disable access to or discontinue, temporarily or permanently, any part or all of the Site or any information or services offered thereon, including your password access (if any), without liability or notice to you.

AskingCanadians does not warrant that the Site and the content are free from errors, computer viruses or other program limitations or that the Site and the content will be accessible and perform in accordance with your expectations. You specifically acknowledge that AskingCanadians will not be liable for any defamatory, offensive or illegal conduct of third parties. The operation of the Site may not be continuous or uninterrupted or secure. Security and privacy risks cannot be eliminated.

9. No Agency

You and AskingCanadians are independent contractors, and no agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship is intended or created by this Agreement and the T&C noted herein.
